FTC To Issue Revised Guidelines for “Green” Product Claims

Many products these days make claims on their labels that place them somewhere on the nebulous spectrum of “green”. These endorsements range from “all natural”, to  “environmentally friendly”, “biodegradable”, or “eco”  just to name a few.

But what do these labels really mean? “Environmentally friendly” compared to what? “Biodegradable” how, and under what conditions?

The fact is, many manufacturers in recent years have taken note of strong consumer appetite for safer products and have responded– but not always with meaningful changes. Products and services that gratuitously toss around vague environmental claims have come to be known as “greenwashing“.

For example, many product labels feature environmental seals – little pictoral “stamps” with a tagline; while there are some legitimate third party verification seals that attest to a products’ safety, environmental performance and/or the manufacturing process, some may be nothing more than ornament. Other examples of deceptive advertising practices may include misleading claims, or overstatement of environmental benefits of a product during its manufacture, use or disposal.

The Federal Trade Commission (FTC) first  adopted its “Green Guide” in 1998 to help provide a baseline of clarity for both consumers and the manufacturers making environmental claims about their products; the revisions that are in the works now will be the first since 1998.

The new revisions will be based on research done by the FTC to gauge consumer understanding of various “green” labeling terms and practices. However, the FTC stops short of providing legal definitions to terms and the guidelines will still be voluntary and self-implemented by manufacturers.

Lighting, Light Bulbs, and Lingering Habits

Research by the California Public Utility Commission staff indicates that if enough existing lighting and lighting for new buildings incorporate the latest technologies, the state could achieve a 60 to 80 percent reduction in light-related energy use. New policies adopted  by the commission promote that goal by encouraging utilities to rethink their current consumer subsidies, which tend to focus on compact fluorescents, in favor of the newer and more energy-efficient technologies. “We need to move on and look at how best to spend our resources on the next step of lighting,” said Theresa Cho, an aide to Commissioner Diane Grueneich. “Our goal is market transformation.” The shelves of Wal-Mart and other big-box stores are already full of compact fluorescents, she said – via the New York Times Green Blog.

A trio of House Republicans, Joe Barton and Michael Burgess of Texas and Marsha Blackburn of Tennessee, have introduced the Better Use of Light Bulbs Act, which would repeal the section of the Energy Independence and Security Act of 2007 that sets minimum energy efficiency standards for light bulbs and would effectively phase out most ordinary incandescents – via the New York Times Green Blog.

The Department of Energy’s inspector general released an audit on Wednesday showing that it is continuing to buy obsolete fluorescent lamps, bypassing the more modern technologies that it spent tax dollars to develop. Yet even more surprising, it is still buying the familiar incandescent bulbs in place of compact fluorescents. The department operates at 24 sites, and the auditors visited seven of them. “Despite the substantial benefits of C.F.L.’s, all of the sites we visited continued to purchase incandescent lights,” the report said – also via the New York Times Green Blog.

The Koch Brothers and AB 32

Today, the New York Times published an editorial about the coalition of oil and gas companies and climate change skeptics that are trying to kill it through Prop 23.

…a well-financed coalition of right-wing ideologues, out-of-state oil and gas companies and climate-change skeptics is seeking to effectively kill that law with an initiative on the November state ballot. The money men include Charles and David Koch, the Kansas oil and gas billionaires who have played a prominent role in financing the Tea Party movement.

The prospect that these rules could reduce gasoline consumption strikes terror into some energy companies. A large chunk of the $8.2 million raised in support of the ballot proposition has come from just two Texas-based oil and gas companies, Valero and Tesoro, which have extensive operations in California. The Koch brothers have contributed about $1 million, partly because they worry about damage to the bottom line at Koch Industries, and also because they believe that climate change is a left-wing hoax.

Resilience vs. Sustainability

Is the glass half-sustainable or half-resilient?

Have you noticed the word ‘resilience’ cropping up in places where you might expect to see the word ‘sustainable’? Are the speakers making a real distinction here, or are they just moving on from yesterday’s buzz word? Let’s find out.

First, Merriam Webster defines the two words as follows:

resilience:

1. the capability of a strained body to recover its size and shape after deformation caused especially by compressive stress

2. an ability to recover from or adjust easily to misfortune or change

sustainability:

1. capable of being sustained

2a. of, relating to, or being a method of harvesting or using a resource so that the resource is not depleted or permanently damaged <sustainable techniques> <sustainable agriculture> 2b. of or relating to a lifestyle involving the use of sustainable methods<sustainable society>

Wow. Does the increased use of ‘resilience’ mean planners and policy makers are becoming more pessimistic? Are they already assuming the worst and now aiming for damage control instead of wise action? Well, maybe. But in all honesty, there is a difference, and it is important to make the distinction. This is not an either/or occasion, but more of a both/and.

Perhaps it seems obvious, but it is crucial to use the right words in order to come as close to the precise meaning as possible. ‘Sustainable’ is a very pro-active word, but it says nothing about the context in which it operates. The word ‘resilience’ by contrast implies a built in complexity; it is a word of reaction, and of endurance. The terms converge, but they are on separate tracks. My point is this – not only do the right words communicate to others better, but the right words can also re-frame the ‘same old thing’  in a beneficial and insightful way. In other words, if sustainability starts at home, maybe spin should too.

What exactly does “sustainability” mean? How about “green”, “eco” or “environmentally friendly”? The truth is that these terms are just vague enough to mean many different things to many different people. With the staggering array of “green” products, ‘lifestyles’ and concepts being promoted by marketers and environmentalists alike (as well as the necessary coining of new terms to match new ideas) our definition series aims to make sense of the rising tide of “eco-lingo” and technical terms.

AC Transit Cuts, part three

Here is a check-in on the ongoing budget crisis within AC Transit, the East Bay’s bus system:

Despite months of negotiations and meetings, AC Transit and the union representing most of its workers,  the Amalgamated Transit Union (ATU), Local 192 have so far been unable to reach a mutually acceptable strategy to close the $56 million deficit facing the agency by the close of 2011.

June 30th represented a milestone in the negotiations- that was the day that the ATU’s previous contract terms expired. The process has nonetheless stagnated. AC Transit Director Greg Harper is quoted in the AC Transit News as commenting, “I think we are definitely at an impasse because the union has so far offered less than 50 percent of what is needed to close the budget deficit.”

The Agency is looking to recoup 8 to 9 percent of employment costs in the new contract. The grim financial scenario has already resulted in fee hikes for riders, service cuts, layoffs, and 5% salary cuts for the board of directors. With a 75% share of the operating budget being allocated to employee costs, the Board of Directors is maintaining that shortfalls cannot be met without some concessions from the union.

The declared impasse and revised terms of employment, effective July 18, have been laid out by the Board of Directors. It remains uncertain if a strike will be avoided.

Editorial – How Much Space is Enough?

Houses have been getting bigger. Over the past fifty plus years (until 2008), the size of the average new house more than doubled, from 1,000 square feet or less in 1950 to 2,265 in 2000 (values from NAHB). The percentage of new homes smaller than 1,200 square feet has been dropping since 1987, while the percentage of new homes larger than 2,400 grew from 21% to 38% between 1987 and 2001 (values from this study). Interestingly, the size of the average new home dropped in 2008 (data here and an article here).

The general trend of larger and larger houses has a direct impact on the environment. Larger houses require more land to build on, more materials for construction, more energy to heat, cool, and light, and result in more waste, both during construction and demolition. While it is expected that there may be some “economy of scale” as houses get larger, there is a widely held suspicion that larger homes consume proportionally more materials because they often have higher ceilings and more complex geometry. Larger houses also require more materials to furnish and decorate.

It should be noted that larger homes are not only increasing in area (square footage); they are also increasing in volume, which may ultimately have a larger impact on the energy consumption of the house. Larger houses are usually constructed with extra features that are not surface area efficient (such as complicated roofs and dormer windows) and which consume more energy for heating and cooling than a compact house of the same volume.

New houses should be both smaller and more compact.

However, it has been difficult to build smaller homes. Aside from the social cache afforded those with larger homes, zoning rules and mortgage practices have also pushed “bigger is better.” For example, mortgage lenders often required the home to be “three times the value of the land,” which then determined a minimum house size for a certain area.

The recent, slight tilt towards smaller home is likely due to the recession and the constrained finances of those building, financing and buying homes. But it is encouraging. When considering what they could afford financially, people chose smaller houses. If we consider what we can “afford” using metrics of energy, water, and materials, we should prioritize building smaller houses.
